MUSICSHAFT.COM has two billing options for website listing. Monthly payments will
automatically deducted on the same day of the month as you subscribe. The yearly
payer agrees to pay in advance at a discounted rate for a 12 month listing. Each
option will automatically renew unless written notice is received by MUSICSHAFT.COM
within 15 days of quit date.
Term
This contract shall be for one year with future years automatically renewable unless
written notice is received within 15 days of quit date. In the event that any obligations,
as a result of the extension of credit or any contractual agreements with MUSICSHAFT.COM,
are placed in the hands of an attorney for collection, the Website Lister also promises
and agrees to pay collection, including reasonable attorney’s fees.
In the event, the Website Lister does not want to meet the minimum contracted for,
the established rate shall still apply and payment in full shall be due upon quit
date. There are no refunds.
MUSICSHAFT.COM reserves the right to terminate the contract with a 30-day written
notice if the Website Lister fails to have a working website link or if the website
contains subject matter that is deemed unacceptable to the content of MUSICSHAFT.COM.
All efforts are made by MUSICSHAFT.COM to resolve any issues prior to written notice.
In the event that MUSICSHAFT.COM does cancel a contract, no further payment shall
be expected from the Website Lister. MUSICSHAFT.COM will not refund any amount.
MUSICSHAFT.COM shall not be held responsible for failure to publish website link
as a result of strikes, riots, accidents, acts of God or other delays beyond its
control and in no event shall be liable for consequential or resulting damage.
I, as authorized agent for the Website Listing, acknowledge the foregoing terms
and conditions of this contract and personally guarantee payment of all sums due
hereunder including costs of collection and attorney’s fees and costs. Website Lister
represents that is has without copyright or other infringement, all ownership of,
or rights to the use of all logos, artwork, photographs, text, images and any other
design concepts and elements used in their website. Website Lister shall indemnify
and hold MUSICSHAFT.COM harmless for any and all copyright or other claims arising
out of content of the Website Lister’s website due to the actions or inaction of
the Website Lister.
